Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Wagyingo Hostel mobile application (the "App"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Wagyingo Hostel mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

To use our App, you must:

• Be at least 16 years old, or have parental/guardian consent if under 18
• Be a student or eligible individual seeking hostel accommodation
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

3. Account Registration and Security

3.1 Account Creation

You are responsible for:

• Providing accurate and complete registration information
• Maintaining and updating your account information to keep it accurate
• Maintaining the confidentiality of your username and password
• All activities that occur under your account

3.2 Account Security

You agree to:

• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others
• Use a strong, unique password
• Log out of your account when using shared devices

4. App Features and Services

Our App provides the following services:

• Room Booking: Browse available rooms, make bookings, and manage your accommodation
• Payment Processing: Upload payment receipts and manage booking payments
Social Feed: Create posts, share content, comment, like, and interact with other users
• Messaging: Send private messages to other users
• Study Groups: Create and join study groups for collaborative learning
• Residents Portal: Access announcements, events, maintenance requests, and community resources
• Profile Management: Create and manage your user profile

5. User Conduct and Prohibited Activities

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Post, share, or transmit any content that is:
• Defamatory, harassing, abusive, threatening, or discriminatory
• Obscene, pornographic, or sexually explicit
• Violent, hateful, or promotes violence
• Infringes on intellectual property rights of others
• Contains false or misleading information
• Spam, unsolicited advertising, or promotional content
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's functionality or servers
• Upload malicious code, viruses, or harmful software
• Collect or harvest information about other users without consent
• Use the App to harass, bully, or harm other users
• Violate any applicable rules or policies of educational institutions

6. Booking Terms

6.1 Booking Process

When making a booking through the App:

• Bookings are subject to availability and approval by hostel management
• You must provide accurate personal and academic information
• Payment must be completed according to the specified terms
• Bookings may be subject to cancellation or modification by the hostel

6.2 Payment Terms

• All payments must be made according to the hostel's payment schedule
• Payment receipts must be uploaded accurately and promptly
• False or fraudulent payment information will result in immediate account termination
• Refunds are subject to hostel policies and applicable laws

6.3 Cancellation and Refunds

Cancellation and refund policies are determined by Wagyingo Hostel management and will be communicated at the time of booking. Please review cancellation terms before confirming your booking.

7. Intellectual Property Rights

7.1 Our Content

The App, including its design, features, logos, text, graphics, and software, is owned by Wagyingo Hostel and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7.2 Your Content

By posting, uploading, or sharing content on the App:

• You retain ownership of your content
• You grant Wagyingo Hostel a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App
• You represent that you have the right to share such content and that it does not violate any third-party rights
• You agree that we may remove content that violates these Terms

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The App is provided "as is" and "as available." We do not guarantee:

• That the App will be available at all times or error-free
• That the App will meet your specific requirements
• The accuracy, completeness, or reliability of any information on the App

9.2 Limitation of Liability

To the maximum extent permitted by law, Wagyingo Hostel shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Any damages arising from your use or inability to use the App
• Content posted by other users or third parties

9.3 No Warranty

We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Wagyingo Hostel, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Content you post or share on the App

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature (if available) in the App settings.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms of Service
• You engage in fraudulent, illegal, or harmful activities
• We are required to do so by law
• You fail to pay required fees or charges

11.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and associated data
• You remain responsible for all charges incurred before termination
• Provisions of these Terms that by their nature should survive will survive

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Sending you a notification
• Updating the "Effective Date" at the top of these Terms

Your continued use of the App after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Negotiation: Parties shall attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes shall be referred to mediation
3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with Ghanaian arbitration laws

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wagyingo Hostel regarding your use of the App and supersede all prior agreements and understandings.
